Public Holidays for Full-timers and Part-timers

  1. Work on a public holiday is voluntary for all employees. However, where sufficient staffing levels are not attained for a public holiday, the company may direct an employee to work their normal roster (or part thereof) on the public holiday. Provided that the company must take into account the employee’s family responsibilities and any other reasonable grounds the employee may have for not working on that public holiday.
  2. Whether your outlet opens or does not open for trade on a public holiday, and you would have been rostered to work,
you are entitled to the day off without loss of pay.
  3. a. Full-time employees whose non-working day falls on a public holiday will receive by mutual agreement either:
    (i) another day off in lieu with pay to be taken at a mutually agreed time within 28 days after the holiday falls, or during the week prior to the holiday, or
(ii) an additional day’s wages, or
(iii) one day added to your annual leave.
    b. (i), (ii) and (iii) shall not apply to Easter Saturday in the case of an employee who works only Monday to Friday.
  4. Part-time employees who work 20 starts per 4 week cycle and whose non-working day falls on a public holiday will receive by mutual agreement either:
    (a) another day off in lieu with pay to be taken at a mutually agreed time within 28 days after the holiday falls, or during the week prior to the holiday, or
    (b) an additional day’s wages, or
    (c) one day added to your annual leave. Those employees who only work Mon-Fri shall not receive the non-work day benefit for Easter Saturday.
  5. For part-time employees, you shall be entitled to 4(a), 4(b) or 4(c) above where you work an alternating roster and the public holiday falls on a non-working day on a day of the week on which you work in any week of your roster cycle.
  6. If an employee elects to work or is required to work on any public holidays, he or she shall be paid at the rate of 250% for all time worked with a minimum payment as for three hours.

Alternatively, TOIL may be provided if a member so elects and it is agreed by the company. Such TOIL must be taken at a mutually agreed time and within four weeks of the public holiday or may be taken as annual leave by mutual agreement.
  7. Where a shift falls partly on a public holiday, the shift that commences on the public holiday shall be regarded as the holiday shift.
  8. Easter Sunday – Because of the strong lobbying by the SDA, Easter Sunday has been legislated as a public holiday throughout Queensland.

Easter Sunday is treated just like any other public holiday on the calendar. Members will be paid public holiday penalties if they work.
