Are you a nightfiller?

April 30, 2018 FAQs Know Your Rights Member News

For 50 years, nightfill has been an integral part of the retail industry. In that time, nightfillers have asked thousands of questions and three of the most common are:

  1. Can I be counselled for not reaching the carton count target set by management?
No. Carton counts that are set by management should only be used as a guide to be used in calculating how many staff are needed to complete the work. The SDA has successfully argued for the principle of ‘a fair day’s work for a fair day’s pay’ in Industrial Commissions. Management can only ask you to work to the best of your ability and any member counselled for not reaching carton counts should contact the SDA immediately.
  2. Do I have to wear the company supplied uniform when working nightfill?
If your employer has provided you with a uniform and asks you to wear it at all times while working, you have an obligation to comply with this direction. Some managers may exercise discretion if all the work is being performed outside trading hours but this would be on a case by case basis.
  3. Are full time nightfillers entitled to all public holidays?
The short answer is that nightfill members are not disadvantaged because they work nights and not days. It is important that night fill members have an understanding of their public holiday entitlements. To assist members, the SDA posts a public holiday bulletin to members before the Easter and Christmas public holidays. This bulletin details public holiday entitlements for full-time, part-time and casual employees. Included in these bulletins is particular reference to nightfillers working across two days and their entitlements when a public holiday falls on a non-working day.

Please contact the union for further clarification or if you believe you haven’t received your full entitlements to public holidays.
