PUBLIC HOLIDAYS FOR FULL-TIMERS AND PART-TIMERS

AFTER STRONG LOBBYING FROM THE SDA, MEMBERS WILL ENJOY 2 ADDITIONAL PUBLIC HOLIDAYS OVER THE CHRISTMAS/NEW YEAR PERIOD.


THE 7 PUBLIC HOLIDAYS FOR THE UPCOMING CHRISTMAS/NEW YEAR PERIOD ARE:

  • Sat, 24 December 2022, 6pm – midnight
  • Sun, 25 December 2022
  • Mon, 26 December 2022
  • Tue, 27 December 2022
  • Sun, 1 January 2023
  • Mon, 2 January 2023
  • Thu, 26 January 2023

Public holiday rates for all employees:

Non rotating afternoon shift hourly allowance $5.89.
Non rotating night shift hourly allowance $7.71.

  1. All weekly team members will be entitled to a day off*, without deduction of pay, where the team member would ordinarily be rostered to work one of the above public holidays and does not work on that public holiday.
  2. Part-time team members will receive a pro-rata entitlement of non-rostered public holidays based on hours worked including ordinary and flexed-up hours.
  3. Order for staffing site – When work is performed on a Public Holiday, the Company shall seek volunteers firstly from:
    (i) Full-time team members, then
    (ii) Part-time team members, then
    (iii) Fixed Term team member, then
    (iv) Casual team members, as per clause 4.3.5, then
    (v) Agency workers
  4. Hours – Hours worked on a public holiday:
    a.
    All shifts for work on a public holiday will be planned around the ordinary working hours of the permanent team member.
    b. For all team members, if an 8 hour shift is offered by the manager and accepted by the team member, 8 hours pay will be paid.
    c. For all team members, if a 10 hour shift is offered by the manager and accepted by the team member, 10 hours pay will be paid.
    d. Team members who work on a public holiday will be paid for a minimum period of 4 hours.
    e. All team members can, by mutual agreement, negotiate shorter hours of work. Team members will not be required to work any longer than the period originally agreed to work, however they may agree to work longer by mutual agreement
  5. Meal Breaks – Afternoon and Night Shift Workers working on a public holiday remain entitled to their paid meal breaks.
  6. Special provisions for Nightshift:
    (a)
    A team member whose ordinary week commences on the night prior to a Monday public holiday may regard this shift as their Public Holiday, and will instead work their ordinary hours on the shift commencing on the night of the Public Holiday.
    (b) A team member whose ordinary week commences on the night of a Monday public holiday, if mutually agreed to, may regard this shift as their Public Holiday.
    (c) For all public holidays which fall on a day other than Monday, the public holiday for nightshift will be the night commencing prior and leading into the public holiday.
    (d) Night Shift team members will have the following option when an entitlement to a day in lieu of a public holiday is owed: The team member may elect three alternate dates of which the company is required to accept one of these as the agreed date which is to be taken within 60 days (the day in lieu will paid at the ordinary wage rate plus applicable shift allowances)
  7. For night shift only – In the case of a Public Holiday falling on a Monday, team members whose ordinary hours include work on a Sunday, will by mutual agreement or by a recommendation of a majority of team members on the shift, not work on the Sunday immediately prior to the Monday Public Holiday and will instead work their ordinary hours on the Monday Public Holiday. Payment for the Sunday not worked will be at the ordinary time rate (i.e. not at the loaded rates detailed in Clause 3.3) and payment for all time worked on the Monday Public Holiday shall be made at a total of 250%.
  8. Casual Team members – If a casual team member is required to work on a public holiday they will be paid the Part Time hourly rate in lieu of the Casual Hourly rate of pay. Casual team members will not be paid the 25% Casual Loading when working on a public holiday because of the other provisions of this clause.
  9. Part day public holidays (Christmas Eve between 6pm and midnight)
    A permanent team member who is normally rostered and volunteers to work the part day public holiday will be paid 250% payment for up to ordinary rostered hours.
    Where a team member who is normally rostered to work and who have not elected to work will be paid
    a. 100% payment without deductions of pay for part day public holiday falling on Monday to Friday; or
    b. When a part day public holiday falls on Saturday or Sunday, the team member will be paid their ordinary wage rate plus appropriate Saturday or Sunday loading for their ordinary hours of work on that day

    Where a casual works a part day public holiday they will be paid 250% of the permanent part time rate for hours worked (up to their ordinary available hours) with a minimum of 4 hours.
    Time in lieu and banked time will not be an available option for the part day public holiday.
TEAM MEMBER STATUS AND ROSTERPUBLIC HOLIDAY BENEFIT
Weekly team members normally rostered and who have volunteered to work have the following options.a. 250% payment for up to ordinary rostered hours worked, or
b. 150% for hours worked plus the equivalent Time Off In Lieu (TOIL) to be taken within 60 days after the public holiday. This TOIL will be paid out if it is not taken within the 60 days.
Weekly team members normally rostered to work and who have elected not to work on a public holiday have the following options.a. 100% payment without deduction of pay when a public holiday falls on Monday to Friday, or
b. When a public holiday falls on a Saturday or Sunday, the team member will be paid their ordinary wage rate plus the appropriate Saturday or Sunday loading for their ordinary hours of work on that day.
Weekly team members on a non-rostered working day who have volunteered to work, have the following options.a. 250% payment for up to ordinary rostered hours worked and 100% for remaining ordinary rostered hours not worked, or
b. 150% for hours worked plus the equivalent Time Off In Lieu (TOIL) to be taken within 60 days after the public holiday. This TOIL will be paid out if it is not taken within the 60 days.
Weekly team members on a non-rostered working day who have elected not to work on a public holiday have the following options.a. An additional days pay without deduction of pay, unless the team member elects b. or c. below, or
b. A Day Off In Lieu (DOIL), subject to mutual agreement, to be taken within 60 days after the public holiday, or
c. An additional day of TOIL OT.
Casual team members who work on a public holiday.a. 250% of the permanent part time rate for hours worked (up to their ordinary available hours), with a minimum of 4 hours.
Casual team member who does not work on a public holiday.a. No payment.
